The policyholder filed a Proof of Loss for costs associated with the repair of the dwelling by replacing it. The policyholder took the position that the foundation sustained expensive damage and could not be repaired. The insurer disputed the amount of the policyholder’s claim and the dispute was resolved by appraisal. After the evidence was submitted and discussed with the Tribunal the insurer announced their desire to discuss resolution of the claim. In the end we were successful in recovering an additional $220,000 on top of what the insurer had already paid, about $150,000.
